Mace Advances America First Fight to Protect America’s Children

(Washington, D.C., August 12, 2025) - Congresswoman Nancy Mace (SC-01) introduced the Gender Affirming Child Abuse Prevention Act, legislation creating a federal right for individuals who received dangerous gender-related medical treatments as minors to pursue justice in court. This legislation ensures victims of irreversible, life-altering procedures can hold perpetrators accountable for the harm they caused.

Congresswoman Mace’s legislation advances President Trump’s mission to end this form of child abuse, building on his Executive Order, “Protecting Children from Chemical and Surgical Mutilation,” signed earlier this year. The order directs federal agencies to cut off funding to hospitals and providers performing these procedures on minors.

“We don’t let minors vote, drive, or get a tattoo for a reason, they’re not yet equipped to make life-altering decisions," said Congresswoman Nancy Mace. “President Trump has taken bold action to protect children from these horrific practices, and this legislation continues the fight. Protecting our children is non-negotiable.”

The Gender Affirming Child Abuse Prevention Act:

  • Creates a Civil Right of Action – Allows individuals to sue those who performed gender-related medical treatment on them while they were under 18.
  • Provides Substantial Damages – Victims can recover actual damages or $250,000 per instance of gender-affirming treatment, plus attorney’s fees.
  • Covers a Wide Range of Procedures – Includes surgeries, hormone treatments, and puberty blockers performed for the purpose of altering a minor’s biological sex characteristics.
  • Protects Legitimate Medical Care – Exempts treatments for diagnosed disorders of sex development, or medical procedures required due to injury, disease, or complications from prior treatment.

This legislation does not interfere with legitimate medical care but targets dangerous procedures performed in the name of so-called “gender affirmation” which carry permanent consequences.

“We’ve reached a point where ideology is overtaking science, and children are paying the price,” Mace added. “If a minor is harmed by these procedures, they deserve their day in court. This bill is about giving them the right to seek justice.”
